Contravention and relocation questions.. need your advice please.
I have a couple of questions regarding a contravention of orders application DH will be filing very soon.

BM moved 3 hrs away with SS about 6 weeks ago, and refuses to supply her new address, as stated in Orders. DH wants to serve her with court papers soon, but we don’t have her address to put on all the paperwork.

Q1 – Can he still file the application without her address on it?( I guess it could only look bad for her.)

There’s also a major alienation thing going on with SS, we’ve not seen him in 6 weeks now. When DH last spoke to him SS said he wasn’t coming for the school holidays because he had big plans at his mum’s. He’s always come for holidays over the last 5 years and now everything’s up in the air.

The situation is getting worse as BM says she is not doing any traveling for the next few months, and DH has to do all the traveling if he wants to see his son. Grrrrrrr. Another contravention. As well as denial of phone contact.

These orders were made 5 years ago, and I have a feeling BM might say these orders no longer reflect the current arrangements. We can only see SS EOW, when it should be 3 out of 5 as stated in orders.

Q 2 – Should DH file for a change of orders as well?

Also, BM has been forcing SS talk with DH about contact time, instead of BM and DH , which is how it should be. BM says “Well he’s 10 now and he can decide for himself whether he wants to come to you or not”. I think its placing too much responsibility on a 10 year old, and BM uses it as an excuse again and again instead of encouraging SS to have contact with our family. I can see it is damaging his relationship with DH and our family.

Q 3 – How much weight would SS10’s wishes have in court and could the magistrate see through the c**p and realize this boy is being manipulated?
